Letter to UAW/CHR Regarding seniority dates

I am writing you, per our discussion, concerning an issue that pertains to the temporary employees who were made permanent on 10/15/2007, the effective date of the 2007 National Agreement. I'm told that those seniority employees have three seniority dates, a Plant Date, Corporate Date and a Plant Tie-Breaker Date. The Plant Tie-Breaker Date being the date they were hired as temporary employees. At this time, we have 247 members with that seniority at Fort Wayne Assembly. Some of those 247 were hired here at Fort Wayne Assembly and some have transferred here from Lake Orion and some recently from Defiance, OH. GMPT. The problem arises when members transfer from one GM facility to another with that seniority date.

Local management states that they are told that when someone transfers with that seniority date their third date changes to the date they arrive at the transferred facility. Document 162 in the 2007 National Agreement "Temporary Employee Placement" states in part "For the purpose of a plant tie breaker, the employee's date of hire as a temporary employee at their current plant will be used”.

Nowhere in this Agreement or the 2007 National Agreement, do I see mentioned a third date. In reference to the tie-breaker date being their Temp. Hire Date. I understand that it only applies to those who have not transferred from their home plant they were hired in.

I was not in office when this agreement was made which makes it confusing and difficult to explain to those who transfer. Other facilities, I’m told, do not use a third date. I would like to arrange a conference call as soon as possible to address and clarify this issue. Your help is appreciated.
